You are bound by your bid or offer, as soon as the other party has accepted it. These are the trading rules according to Danish Commerce Law in private trades. jvf. Aftalelovens §1
What is a bid, and when is there a deal?
It doesn't make a difference whether a bid or an offer is given in a comment or in a private message. All kinds of bids or offers are equally binding. As soon as the other party has accepted the bid or offer, there is a deal which both parties are obligated to keep.
For buyers
As a buyer, you must be sure that you have the desire and ability to purchase an item, before you put a bid on it or accept an offer from a seller. Therefore, make sure to ask all relevant questions and ask for extra pictures, if you're having any doubts. If you're uncertain whether you can afford an item, make sure to check your bank account prior to making a deal :)
By doing so, you'll spare yourself and the seller a bad experience.
If you regret a bid that you've put on an item, you can always withdraw your bid, as long as the seller hasn't accepted the bid yet. Your bid is valid for 7 days. After this, you are no longer bound by the bid, unless it has already been accepted by the seller.
For sellers
If you've accepted a bid from a buyer, or if you've given a buyer an offer, which has been accepted, you've entered a binding deal and it is not possible to sell the item to other buyers or withdraw the deal, even if you receive higher bids from other buyers.
Conditions in a deal
If you have any conditions in regards to the deal, you must always state them before the deal is made. A condition could be that you are not able to pay before next week, or that you want the item shipped to you and that the price you're bidding is including shipping.
As a buyer, you must state your conditions as part of your bid or before you accept an offer from a seller. As a seller, you must state your conditions as part of your offer or before you accept a bid from a buyer.
If these rules are not respected by a party in the trade, it will trigger a warning. Therefore, if you experience someone not keeping their deal, please report the incident to our support team.
